King George, Virginia

17 December 2020

Fellow Members of the King George TEA Party:

<Snip> and his family will host a Christmas get together and do some "curfew caroling"
TOMORROW (Friday) evening, 18 December 2020, from 11:30 PM to 12:30 AM (Saturday morning).  Due to sleeping kids, they will hold it mostly outside with indoors access for warmth.  If someone has a portable fire pit, we will get it going with wood that they have.  They will have some light snacks and hot chocolate.  People are free to bring snacks to share.  The address is <Snip>, King George 22485.

This is a SOCIAL event and PROTEST event to demonstrate public displeasure with the absolutely ridiculous COVID-19 curfew that Governor Northam has imposed.  See this link for more information:

  • EXECUTIVE ORDER NUMBER SEVENTY-TWO (2020) AND ORDER OF PUBLIC HEALTH EMERGENCY NINE COMMONSENSE SURGE RESTRICTIONS CERTAIN TEMPORARY RESTRICTIONS DUE TO NOVEL CORONAVIRUS (COVID-19)
  • https://www.governor.virginia.gov/media/governorvirginiagov/executive-actions/EO-72-and-Order-of-Public-Health-Emergency-Nine-Common-Sense-Surge-Restrictions-Certain-Temporary-Restrictions-Due-to-Novel-Coronavirus-(COVID-19).pdf

Specifically, this is the passage that clarifies what Governor Northam has permitted you, as a free American citizen that otherwise has First Amendment rights under the Constitution or the United States of America, to perform (meaning that this curfew is unconstitutional):

"All individuals in Virginia should remain at their place of residence between the hours of 12:00 a.m. and 5:00 a.m. Individuals may leave their residences for the purposes of:

  • Obtaining food, beverages, goods, or services as permitted in this Order;
  • Seeking medical attention, essential social services, governmental services, assistance from law enforcement, or emergency services;
  • Taking care of other individuals or animals;
  • Traveling required by court order or to facilitate child custody, visitation, or child care;
  • Engaging in exercise, provided individuals comply with social distancing requirements;
  • Traveling to and from one’s residence, place of worship, or work;
  • Traveling to and from an educational institution;
  • Volunteering with organizations that provide charitable or social services; or
  • Leaving one’s residence due to a reasonable fear for health or safety, at the direction of law enforcement, or at the direction of another government agency."

Notice that the Executive Order used the word “should”, and not “shall” in the edict.  Thus, there is no real “teeth” in this EO.  Aside from that, however, I think he needs a bit of “I Will Not Comply” coal to go into his Christmas stocking.
